ABUJA, Nigeria — June 19, 2026 — The National Industrial Court of Nigeria sitting in Abuja has dismissed a suit filed by retired Major General Danjuma Hamisu Ali-Keffi challenging his compulsory retirement from the Nigerian Army and alleging violations of his fundamental human rights.
The court delivered its ruling on Friday, June 19, 2026, after considering a preliminary objection raised by the Nigerian Army. The court held that the retired general’s case was statute-barred, meaning it was filed outside the legally permitted time limit.
Ali-Keffi had approached the National Industrial Court seeking legal redress over his retirement from service, arguing that the action taken by the Nigerian Army was unlawful and violated his rights. Reports indicate that the retired officer sought several reliefs, including the nullification of his compulsory retirement and recognition that he should have been treated as voluntarily retired upon reaching the appropriate retirement age.
The former military officer also reportedly demanded payment of his pensions, gratuities, and other entitlements, alongside additional compensation linked to his claims.
However, the Nigerian Army challenged the suit, arguing that the case was filed after the expiration of the legally required period for such a claim. The Army’s objection was upheld by the court, which ruled that it lacked jurisdiction to proceed with the matter because of the delay in filing.
A source familiar with the proceedings said the court ruled that the matter was filed after the three-month period provided under applicable constitutional and legal provisions had expired.
The judgment did not proceed into a full hearing of the allegations surrounding Ali-Keffi’s retirement. Instead, the case was dismissed on procedural grounds.
The court also reportedly stated that issues relating specifically to alleged fundamental human rights violations were outside its jurisdiction in the circumstances, noting that such claims could be pursued at the Federal or State High Courts where applicable.
Ali-Keffi’s legal team is expected to review the judgment and decide on the next legal step, including the possibility of filing an appeal.
