A 24-year-old man from Ekiti State, Item David, has been remanded in a correctional facility for allegedly distributing nude photos and videos of his former girlfriend, Moshood Funmilayo, to her family, friends, and on social media platforms in Ado Ekiti, the state capital. The case was brought before the Ado-Ekiti Chief Magistrates’ Court on Thursday, with charges of cyberstalking filed against him by the police.
According to Prosecutor Inspector Akinwale Oriyomi, the incident occurred on January 20, when the defendant deliberately circulated explicit images and videos of the complainant to her acquaintances following the end of their relationship. The complainant had informed the defendant that she was no longer interested in continuing the relationship. In response, Item David reportedly threatened to harm her reputation and proceeded to distribute the material via WhatsApp, causing distress and embarrassment.
The actions of the defendant contravene Section 24(a) and (b) of the Cybercrimes (Prohibition, Prevention, etc.) Act 2024, as amended, which prohibits the unauthorized sharing of intimate images and videos. The defendant did not enter a plea during the court proceedings.
The prosecutor requested that the court remand the defendant in a correctional facility pending legal advice from the Director of Public Prosecution (DPP). Chief Magistrate Abayomi Adeosun granted the request, ordering that Item David remain in custody until the DPP’s guidance is received. The matter has been adjourned to February 27 for further hearing.
The case highlights ongoing challenges in addressing cybercrime and the non-consensual distribution of intimate content, underscoring the legal protections now afforded under Nigeria’s updated cybercrime legislation.
