Sheikh Ahmad Gumi Calls for Islamic Judges to Grant Abused Women Right to Divorce Without Compensation

Renowned Islamic scholar Sheikh Ahmad Gumi has called on Islamic judges and clerics to grant Muslim women facing domestic abuse the right to divorce their husbands without being forced to pay compensation.

Gumi made the appeal during his weekly Tafsir session at the Sultan Bello Mosque in Kaduna, while delivering a lecture titled “How Wives in Islam Can Also Divorce Their Cruel Husbands Without Compensation.”

He stated that Islam does not condone oppression in marriage and emphasized that both men and women have equal rights to end a union when love, peace, and respect have broken down. Citing Al-Mukhtasar Al-Khalil, a Maliki jurisprudence text, Gumi stressed that all marital rulings must be guided by justice.

“A husband can simply utter words and end a marriage, but when a woman seeks freedom from an abusive man, she is told to pay compensation. That is injustice, and Islam stands against oppression,” Gumi said.

Quoting verses from the Qur’an (Q4:35, Q4:19, and Q4:130), he noted that Allah allows separation when harmony is lost and urged fairness in handling divorce matters. He condemned the rising cases of domestic violence and criticized men who abuse their wives yet refuse to release them unless they pay through khul’ (compensatory divorce).

“When a husband insults, humiliates, or beats his wife, he forfeits the right to demand compensation. It becomes the duty of the judge to dissolve such a marriage immediately. No woman should be trapped in misery,” he added.

The cleric urged Islamic judges (Qadis) to protect women from injustice, act with fairness, and uphold the principles of mercy and equality in Islam. He concluded that a healthy marriage must be rooted in kindness and mutual respect, warning that when these values disappear, either partner has the right to walk away with dignity.
