Court Declares Zamfara Lawmaker’s Seat Vacant Over Defection to APC

The Federal High Court in Abuja has declared the seat of Hon. Abubakar Gummi, member representing Gummi/Bukkuyum Federal Constituency of Zamfara State, vacant following his defection from the Peoples Democratic Party (PDP) to the All Progressives Congress (APC).

Delivering judgment, Justice Obiora Egwuatu ruled that lawmakers elected on a political party’s platform cannot transfer the people’s mandate to another party, stressing that such an act violates constitutional provisions and undermines democratic representation.

Justice Egwuatu consequently ordered the Independent National Electoral Commission (INEC) to conduct a fresh election within 30 days to fill the vacant seat.

The court’s decision reaffirms the legal stance that defection without a division in a political party is unconstitutional, reinforcing the judiciary’s commitment to upholding party integrity and voter mandate in Nigeria’s democratic system.
