The trial of former Minister of Power and Steel, Olu Agunloye, resumed on Thursday, October 9, 2025, at the Federal Capital Territory High Court, Apo, Abuja, presided over by Justice Jude Onwuegbuzie. During proceedings, the third Prosecution Witness, Umar Hussein Babangida, testified that Agunloye ignored the directive of the Federal Executive Council (FEC) meeting held on May 21, 2003, by awarding the Mambilla Power Project contract to Sunrise Power and Transmission Company Limited valued at $6 billion.

Under cross-examination by Agunloye’s counsel, Adeola Adedipe, SAN, Babangida maintained that the FEC, chaired by then-President Olusegun Obasanjo, had explicitly resolved that the contract should not be awarded to Sunrise Power. Despite the resolution, Agunloye allegedly proceeded to approve the contract.

Agunloye is facing amended seven-count charges from the Economic and Financial Crimes Commission (EFCC), including allegations of official corruption and fraudulent award of the Mambilla Power Project. One of the counts states that Agunloye knowingly disobeyed the President’s directive during the FEC meeting when he signed a letter granting approval for the construction of the 3,960-megawatt Mambilla Hydroelectric Power Station, an act contrary to Section 123 of the Penal Code Law.

The defendant pleaded not guilty, and Justice Onwuegbuzie adjourned the trial to November 3, 10, 12, and December 1, 2025 for further proceedings.
