The National Association of Nigerian Students has condemned the remand of the immediate past President of the Students' Union Government of the Federal University Oye-Ekiti, Comrade James Iyanuoluwa Adio, by a Magistrate Court in Ekiti State, describing the development as a grave miscarriage of justice and a violation of the student leader's fundamental rights. In a statement issued on Monday, July 27, 2026, NANS National President, Comrade Akinteye Babatunde Afeez, alleged that Adio was remanded despite being the complainant in the matter before the court, insisting that the former student leader had no criminal charges against him.
According to the statement, Adio had personally instituted the legal action before a Magistrate Court in Ado-Ekiti, but the case was allegedly turned against him through the actions of the Directorate of Public Prosecutions and the presiding magistrate. "I have just been briefed that the Magistrate Court in Ekiti State has remanded the immediate past FUOYE SUG President, Comrade Adio, in prison over a matter that he personally instituted before the court," Akinteye said. He added: "From the facts available to us, Comrade Adio was the complainant and had no criminal case against him. It is therefore deeply disturbing that the matter was allegedly turned against him through the actions of the Directorate of Public Prosecutions and the presiding Magistrate".
The NANS president described the development as "judicial rascality, a gross abuse of due process and a violation of Comrade Adio's fundamental rights". In response to the remand, Akinteye disclosed that he had directed the NANS Joint Campus Committee Chairman for the Ekiti Axis and the association's National Head of Administration to begin immediate mobilisation for peaceful demonstrations in the state. "Peaceful actions will be taken to demand justice, including lawful protests at the Ekiti State High Court, the Magistrate Court and the office of the Directorate of Public Prosecutions until Comrade Adio is released and justice is served," he stated.
In a separate open letter addressed to Ekiti State Governor Biodun Oyebanji, the state's Chief Judge, and the Attorney-General and Commissioner for Justice, NANS provided further details of the dispute. According to the association, Adio approached the court after private, consensual moments between him and another adult were allegedly recorded and circulated on social media without his consent. The association maintained that the case originally centred on allegations of cyberbullying and the unlawful publication of private media. However, NANS claimed that proceedings before Magistrate Abayomi Adeosun at the Magistrate Court in Fajuyi, Ado-Ekiti, shifted focus to the personal conduct of the parties involved, leading to the magistrate ordering the remand of Adio alongside the defendants until August 4, 2026.
NANS further alleged that during the proceedings, the Director of Public Prosecutions, Akinlabi O.O., and the Director of Citizenship Rights, H.A. Adeyemi, argued that the Federal University Oye-Ekiti treated the parties differently by suspending only the female involved while allowing Adio to sit for his examinations. However, the association insisted that Adio's legal team presented records showing his earlier suspension was unrelated to the matter before the court and that he had since been exonerated and reinstated.
The association has called for Adio's immediate release, the reassignment of the case to another magistrate, and an independent review of the remand order. NANS also demanded an investigation into the conduct of officials involved in the prosecution and warned that it would petition the National Judicial Council and other relevant authorities if its concerns were not addressed. The student body reaffirmed its commitment to defending the rights of Nigerian students and promoting the rule of law. "The National Association of Nigerian Students will not stand by while the rights of Nigerian students are trampled upon. We remain committed to defending justice, the rule of law, and the fundamental rights of every Nigerian student," Akinteye said.
As of Tuesday, July 28, 2026, the Ekiti State Ministry of Justice and the judiciary had not publicly responded to the allegations raised by the student body. The court's remand order remains in force pending further proceedings. The development comes weeks after NANS intervened in issues surrounding Adio's suspension as FUOYE SUG president, with the association consistently calling for due process in the handling of disciplinary and legal matters involving the former student leader. The case has now become a test of judicial fairness and due process in Ekiti State, with the nation's largest student body vowing to deploy its organisational machinery to secure what it describes as justice for one of its own.
