A Federal High Court in Lagos has ordered the National Drug Law Enforcement Agency to produce detained social media influencer and businessman Afolabi Kazeem Michael, popularly known as KC Luxury, after he spent 14 days in custody without being formally charged.
Justice Friday Ogazi issued the order on Thursday, August 27, 2026, following an ex parte application filed by the suspect through his lawyer, A. Labi-Lawal, a Senior Advocate of Nigeria. The court also directed the NDLEA to respond within five days to a fundamental rights application challenging his continued detention and to show cause why he should not be released or granted bail.
KC Luxury was arrested at the Murtala Muhammed International Airport in Lagos on August 13, 2026, while preparing to board a business-class flight to Paris. The NDLEA accused him of being the Nigerian arrowhead of an international cocaine trafficking cartel that used Nigeria as a transit hub to move drugs to the United Kingdom, Europe and Asia. The investigation followed the interception of 184.50 kilogrammes of cocaine with an estimated street value of N39 billion.
Through his father, Eric Afolabi, who deposed to an affidavit in support of the application, KC Luxury alleged that he had remained in NDLEA custody without being informed of the specific offence for which he was being held. He contended that his continued detention without a formal charge violated his constitutional right to personal liberty.
In the substantive suit, KC Luxury is seeking declarations that his detention is unconstitutional. He is also asking the court to order his immediate release or, alternatively, to admit him to bail on liberal terms pending any formal charge. He further alleged that NDLEA operatives searched his Banana Island residence without a warrant and found nothing incriminating. He also claimed that his iPhone 15 was seized and that he was threatened with bodily harm to disclose its password. He further accused the agency of circulating photographs and videos of him while in custody, which he argued violated his right to dignity and privacy.
The court adjourned the case to September 9, 2026, for the hearing of the substantive application. Justice Ogazi directed that the NDLEA be served with the ex parte motion and other court processes within four working days, and ordered the agency to file its response within five days of service. KC Luxury is seeking N100 million in damages for the alleged circulation of his photographs and videos, N50 million for unlawful arrest and detention, and N40 million for invasion of his privacy.
