INEC Refutes Misleading Media Reports on Court Order Against Former Chairman

The Independent National Electoral Commission (INEC) has dismissed circulating media reports claiming that the Federal High Court in Osogbo, Osun State, issued an arrest order for its immediate past Chairman, Prof. Mahmood Yakubu, over alleged disobedience to a court judgement involving the Action Alliance (AA) party.

In a statement issued on Thursday, 9th October 2025, by Sam Olumekun, National Commissioner and Chairman of the Information and Voter Education Committee, INEC clarified that the reports were misleading and incomplete, as they failed to reflect the Commission’s subsequent actions in compliance with the court’s decision.

According to INEC, the Federal High Court’s initial pronouncement was made on 29th September 2025, but contrary to the impression created by the reports, the Commission took prompt steps within the legal timeframe to comply. On 6th October 2025, INEC filed its compliance processes at the same court, showing that it had recognised the Action Alliance’s executive elected on 7th October 2023 in Abeokuta, Ogun State. The Commission even tendered its website dashboard as evidence of compliance.

Olumekun explained that a counter-affidavit later filed by the judgement creditors alleged partial compliance because INEC had listed four national executives without including Mr. Rufai Omoaje as National Chairman. The Commission responded by submitting a copy of the Notice of Appeal filed by Omoaje at the Supreme Court, where he is challenging the Court of Appeal’s judgement that removed him as chairman.

INEC emphasised that since the Court of Appeal’s decision supersedes that of the Federal High Court, it would be legally improper to list Omoaje as chairman while the appeal remains unresolved.

Reaffirming its long-standing commitment to judicial integrity, INEC stated that it “has always obeyed court judgements and orders” and urged media organisations to verify information before publication to prevent the public from being misled.
