A 23-year-old Omaha man has been sentenced to 10 years and one month in federal prison after using the artificial intelligence chatbot ChatGPT to meticulously plan an armed bank robbery, a case that has drawn international attention to the dark side of generative AI. Deron Lewis-Payne was handed down the sentence on August 13, 2026, by a federal court in Omaha, Nebraska, after pleading guilty to bank robbery and using, carrying, and brandishing a firearm during a crime of violence. The sentence is comprised of 37 months for the robbery itself and an additional 84 months for threatening bank employees with a weapon. Upon his release, Lewis-Payne will be subject to an additional five years of supervised release.

The heist itself was as straightforward as it was foolish. On February 10, 2026, Lewis-Payne walked into an i3Bank branch in Omaha, pointed a .45 caliber Llama Mini-Max pistol at bank tellers, and threatened to kill them before fleeing with approximately $9,175 in cash. However, the robbery was a spectacular failure from the start. Surveillance cameras inside the bank clearly captured his unmasked face, the firearm, and even the distinctive red sneakers he was wearing. His escape vehicle was also recorded by nearby security cameras. In perhaps the most damning display of incompetence, Lewis-Payne was later captured on video at a local shopping mall, using the stolen cash to buy new clothes. He was arrested not far from his home after a clumsy foot chase during which he dropped a bundle of banknotes.

The pivotal breakthrough for investigators came when Lewis-Payne, despite denying any involvement in the robbery, consented to a search of his phone. What officers found was a digital blueprint of the crime. The phone contained extensive evidence that Lewis-Payne had used ChatGPT to plan the robbery, including queries about police response times, how to disassemble and repair his pistol, and how to obtain ammunition despite being a convicted felon. His Google Maps history further sealed his fate, showing that his last search was for directions to the very bank he had robbed.

The case highlights a growing challenge surrounding the misuse of generative AI. Tools like ChatGPT, designed to provide information and assistance, are increasingly being exploited by individuals attempting to facilitate criminal activity. However, the Lewis-Payne case serves as a stark warning that technology does not grant criminals invisibility. Digital records, surveillance footage, location history, and physical evidence can leave investigators with multiple avenues to reconstruct a crime and identify the perpetrator. For Lewis-Payne, his reliance on artificial intelligence did not prevent his capture; instead, it became a central piece of evidence in a federal case that has now earned him more than a decade behind bars.
