Federal High Court Denies Interim Injunction Against PDP NEC Meeting, Convention

Abuja – The Federal High Court in Abuja on Thursday refused to grant an interim injunction aimed at halting the Peoples Democratic Party (PDP) from holding its planned National Executive Committee (NEC) meeting and national convention scheduled for October and November 2025.

Delivering the ruling, Judge J.K. Omotosho declined to grant the interim orders filed by Austine Nwachukwu, chairman of PDP in Imo State; Amah Nnanna, chairman of the Abia State chapter; and Turnah George, secretary of the PDP South-South zone. The plaintiffs had sought to restrain the party leadership and the Independent National Electoral Commission (INEC) from organising or recognising the meetings without following due democratic procedures.

The judge emphasised that the defendants—INEC, the PDP, and its principal officers—must first be served with the substantive motion on notice before any restraining order could be considered. “The Motion Ex parte for Interim Injunction is hereby refused. The Plaintiffs/Applicants are hereby ordered to serve the Defendants with the Motion on Notice for Interlocutory Injunction,” he ruled.

Mr. Omotosho also cautioned all parties against actions capable of undermining the pending judicial process. “Any step, decision or act taken to make the outcome of a judicial process such as the Motion on Notice for Interlocutory Injunction nugatory shall be deemed null and void. Upon being served with a court process, no party shall take any steps to frustrate its outcome,” he added.

The court adjourned the matter to October 14, 2025, for hearing of the motion on notice for interlocutory injunction. The plaintiffs, reportedly allies of FCT Minister Nyesom Nyesom, are seeking to compel INEC to enforce its constitutional role in monitoring the internal affairs of the PDP, alleging violations of the party’s constitution and democratic norms.
