Court Upholds Governor Diri’s Decision to Remove Otuokpoti CDC Chairman

The Bayelsa State High Court sitting in Yenagoa, Ogbia Division, has affirmed the decision of Governor Douye Diri to remove Mr. Anthony Azibalua as Chairman of the Otuokpoti Community Development Committee (CDC), citing procedural flaws in the case challenging the action.

Delivering judgment on Tuesday, October 21, 2025, in Suit No. BYHC/OHC/CV/29/2024, Justice (Dr.) S.W. Amaduobogha ruled that the claimant adopted an improper method of initiating the legal process, which consequently deprived the court of jurisdiction to hear the matter.

Mr. Azibalua had approached the court through an Originating Motion, seeking a judicial review to overturn his removal by the Governor. However, the court struck out the suit and dismissed all reliefs requested, effectively validating Governor Diri’s decision.

Speaking after the ruling, the Bayelsa State Attorney-General and Commissioner for Justice, Mr. Biriyai Dambo, SAN, commended the judgment, describing it as a sound legal pronouncement grounded in due process.

He noted that the Governor’s actions remain rooted in the pursuit of peace, stability, and community development across Bayelsa State. Mr. Dambo further reaffirmed that the current administration maintains a firm stance against conduct that threatens harmony within local communities, emphasizing that Governor Diri’s leadership prioritizes order and progress for all.
