The Anambra State Government has launched a plea bargain initiative aimed at decongesting correctional centres and courts across the state, with the policy excluding defendants charged with murder, kidnapping, armed robbery, and rape. The Attorney General and Commissioner for Justice, Professor Sylvester Ezeokenwa, made the announcement on Friday, July 24, 2026, during an interview with journalists in Awka. He explained that the initiative was designed to address the growing congestion in the state's correctional facilities, where a significant number of inmates are awaiting trial.
According to the Attorney General, the policy will target inmates who have been awaiting trial for extended periods, particularly those who may have been in custody for longer than they would have served if convicted. The policy provides an opportunity for eligible inmates to plead guilty to lesser offences in exchange for reduced sentences, thereby expediting the judicial process and reducing the burden on the courts. "This initiative is aimed at fast-tracking the resolution of cases and decongesting our correctional centres. It will benefit those who are willing to accept responsibility for their actions and are not involved in capital offences," Ezeokenwa stated.
The Attorney General listed the categories of defendants excluded from the plea bargain policy as those charged with murder, kidnapping, armed robbery, and rape. He emphasised that these serious offences would continue to be prosecuted in accordance with the full extent of the law. The initiative is a significant step in the state's efforts to reform its justice system, which has been plagued by delays and overcrowding. It aligns with similar efforts at the federal level and in other states, where plea bargain policies have been used to reduce case backlogs and improve the efficiency of the judiciary.
Ezeokenwa further noted that the Anambra State Government was committed to ensuring that the policy is implemented transparently and fairly. He disclosed that the Ministry of Justice would be working with the judiciary, correctional services, and other stakeholders to ensure a smooth rollout of the programme. The Attorney General also appealed to judges, magistrates, and legal practitioners to support the initiative to ensure its success. He stressed that the policy was not intended to undermine the justice system but to make it more efficient and responsive to the needs of the people.
The Governor of Anambra State, Professor Chukwuma Charles Soludo, has expressed his support for the initiative, describing it as a practical solution to the problem of prison congestion in the state. A government source said the Governor had directed the Attorney General to ensure that the policy is implemented in accordance with the law and that justice is served in all cases. The Nigerian Bar Association in Anambra State has also welcomed the initiative, describing it as a positive development that would enhance the administration of justice in the state. However, some legal practitioners have cautioned against the potential abuse of the policy and have called for strict monitoring of its implementation.
The Commissioner of Police in Anambra State, CP Nnaghe Itam, also expressed support for the initiative, adding that it would help reduce crime and improve the efficiency of the criminal justice system. He assured that the police would cooperate with the Ministry of Justice and other stakeholders in implementing the policy. He noted that a preliminary assessment of the criminal cases in Anambra State indicated that many of the cases could be resolved through plea bargains, which would help decongest the prisons and courts.
The plea bargain initiative is part of a broader effort by the Anambra State Government to reform the justice system and improve access to justice for all citizens. The government has also been working to improve the infrastructure of the courts and correctional centres, as well as to enhance the capacity of legal practitioners and judicial officers. As the policy takes effect, it is expected to lead to the release of a significant number of inmates and reduce the backlog of cases in the courts. It is also expected to save the government millions of naira that would have been spent on the upkeep of inmates, while also allowing the judiciary to focus on more serious cases.
