NBA warns of contempt and disciplinary proceedings over alleged disregard for court orders
The Nigerian Bar Association (NBA) has formally notified the Nigeria Police Force (NPF) of the pendency of Suit No. FHC/ABJ/CS/1821/2025, which challenges the legality of the tinted glass permit policy. The NBA has demanded the immediate suspension of all actions related to the policy, warning that any enforcement contrary to the court proceedings could constitute contempt of court.
In a statement, the NBA emphasized that the rule of law must prevail and cited the Supreme Court and Court of Appeal in noting that pending litigation on a matter automatically restricts enforcement of the policy until the court delivers a determination. The NBA described any attempt to enforce the policy while the suit is pending as an egregious act of disregard for the judiciary and a potential violation of legal protocols.
The association further indicated that NBA-SPIDEL, the NBA Section on Public Interest and Development Law, is prepared to initiate contempt and disciplinary proceedings against any officer found to be defying court authority. Specifically, the NBA warned that CSP Benjamin Hundeyin, who presented a press release suggesting continued enforcement of the policy, could face contempt or committal proceedings if he fails to desist from such actions.
Additionally, the NBA advised the Officer-in-Charge of the Directorate of Legal Services, AIG Ohiozoba O. Ehiede, to provide proper legal guidance to ensure the Nigeria Police Force adheres to the law and avoids interference with ongoing court proceedings. The NBA stressed that failure to comply could result in disciplinary measures, including proceedings before the Legal Practitioners Disciplinary Committee (LPDC).
The association concluded by reiterating the importance of upholding the authority of the judiciary, warning that all enforcement actions contrary to the pending litigation would be met with appropriate legal responses. The NBA’s intervention underscores its commitment to ensuring compliance with the rule of law in Nigeria.
