The Federal High Court in Lokoja has upheld the constitutional validity of the Advertising Regulatory Council of Nigeria (ARCON) Act 2022, confirming the agency’s regulatory authority over outdoor advertising nationwide.
Delivering judgment on November 12, 2025, Justice Isa Dashen dismissed a suit filed by Godec Power Nigeria Ltd, which had sought to challenge ARCON’s power to regulate outdoor advertising. The court ruled that ARCON’s oversight of advertising content on all platforms targeting the Nigerian market falls within its statutory mandate.
Godec Power had argued that regulation of outdoor signage is exclusively under the jurisdiction of local government councils, as outlined in paragraph 1(k)(i) of the Fourth Schedule to the Constitution. The company also claimed that ARCON’s notice of violation infringed upon its constitutional right to freedom of expression.
The court’s decision reinforces ARCON’s authority and clarifies that local governments do not have unilateral control over outdoor advertising, strengthening the agency’s regulatory oversight across Nigeria.
