Court Grants Bail to 66‑Year‑Old Lawyer and One Other Accused of Using Fake LIRS Stamps to Obtain Judgment

A 66‑year‑old lawyer, Tunde Awogbade, and another man, Obayomi Olaleye, have been arraigned before an Igbosere Magistrate Court sitting at the Tinubu Magistrate Court in Lagos on six criminal charges that include conspiracy, perjury, forgery, breaking and entry, assault occasioning harm, malicious damage and perversion of justice. The police alleged that the two defendants, together with other persons still at large, forged the official stamps of the Lagos State Internal Revenue Service and the Commissioner for Stamp Duties, as well as the signature of one Paul Orizu on a Power of Attorney dated 14 December 2019. The prosecution further claimed that between 6 January and 22 June 2023, in the Orile‑Iganmu area of Lagos, the defendants conspired to commit the offences, later made false declarations on oath at the Chief Magistrate Court, Yaba on 12 July 2024, and then used the forged documents to obtain a judgment, thereby perverting the course of justice.

The charges also include a break‑in at Borngreat Health Care & Research Laboratories located at No. 12 Lagos‑Badagry Expressway, Orile‑Iganmu. According to the prosecution, the defendants and their accomplices broke into the facility on 22 June 2023 at about 2 p.m. and carted away pharmaceutical products valued at N300,000. They are also accused of assaulting the nominal complainant, Paul Orizu, with fist blows, machetes, clubs and other offensive weapons, inflicting bodily harm on him. The prosecutor further alleged that the group wilfully destroyed medical equipment, machines, televisions, refrigerators, human blood samples, patients’ medical results, medical record books, company registration documents, certificates, laboratory operational licences and drugs, all property of Borngreat Health Care & Research Laboratories, with the total value of the destroyed property placed at N350 million.The offences are said to contravene Sections 411, 86(1), 365(2)(a)(b), 309(1)(2), 173, 350 and 351(d)(vi)(b) of the Criminal Law of Lagos State, 2015.

When the six‑count charge was read to them, both defendants pleaded not guilty. The prosecution counsel, CSP Monday Omo‑Osagie, immediately urged the court to remand the defendants pending trial. Magistrate Olatunde Adefope, however, granted bail to the defendants on different terms. The court admitted the 66‑year‑old lawyer, Tunde Awogbade, to bail on self‑recognition, but ordered him to produce his original Call to Bar certificate and provide one surety. The first defendant, Obayomi Olaleye, was granted bail in the sum of N10 million, with two sureties in like sum. The court stipulated that the sureties must be residents of Lagos State and must provide evidence of tax payment to the Lagos State Government.

Pending the perfection of their bail conditions, both defendants were remanded in the Ikoyi Correctional Centre. The case has been adjourned to 19 June 2026 for further proceedings.
