Legal Experts Say Nnamdi Kanu’s Recent Conviction Is Invalid and Cannot Stand

The Mazi Nnamdi Kanu Global Defence Consortium has announced that the court ruling handed down on November 20, 2025, is legally invalid and should not be upheld. The court convicted Nnamdi Kanu under a law that has already been repealed—specifically the 2013 Terrorism (Prevention and Prohibition) Act.

Legal experts explain that according to the current law, the 2013 Act was fully canceled in 2022 and no longer exists. This means the court had no valid law to base the conviction on. Nigeria’s Constitution also states that no one can be convicted unless the offence and its punishment are clearly written in a law that is in force on the day of the trial. Since the law used in this case was no longer in force on November 20, 2025, the conviction is invalid.

The prosecution tried to argue that a “savings clause” in the current law would keep the case alive, but legal experts say this is wrong because such clauses only apply to cases that were already pending before the law was repealed. Since Nnamdi Kanu’s case was not pending at that time, the law cannot be used to justify the conviction.

Additionally, the new 2022 Terrorism Act narrows what counts as terrorism. It only covers acts involving violence or serious harm. Nnamdi Kanu’s speeches, broadcasts, and political activism do not meet this definition, so the charges against him are not valid under the current law.

The experts emphasize that Nigeria’s Constitution requires courts to use the more favorable and current law—in this case, the 2022 Act. The court’s decision to convict Nnamdi Kanu under an outdated law and ignore the current law violates the Constitution and the principles of justice.

The defence team states that they will appeal the judgment, arguing that it is legally flawed and cannot stand up in higher courts. They are confident that the Court of Appeal will correct the mistake, restore legality, and vacate the conviction.
